What If My Trustees Are No Longer Living?
When a trustee passes away, a co-trustee (if named) typically continues to manage the trust alone—unless the trust states otherwise. Eventually, when no co-trustees remain, a successor trustee—previously named in the trust—takes over.
If you’re the trustee of your revocable trust, a designated successor trustee will step in after your passing. At that point, your revocable trust becomes irrevocable, meaning its terms can no longer be changed.
For irrevocable trusts—often created with someone other than the grantor as trustee—a successor trustee named in the trust will assume responsibility if needed. These types of trusts are harder to alter but offer advantages such as tax benefits.
If no successor trustee is listed and all original trustees have passed:
- The personal representative of the last trustee may have the authority to appoint a replacement.
- If not, the probate court will assign a new trustee—usually after a request from beneficiaries or family members.

- Distributing assets according to the trust terms.
- Handling taxes and any debts owed by the trust.
- Managing property and accounts until distributions are complete.
